This programme is an EC initiative, implemented by the European Patent Office (EPO), the Office for Harmonisation in the Internal market (OHIM) and ERIN, in cooperation with various Chinese agencies: MOFTEC, State Intellectual Property Office (SIPO), Trademark Office (TMO), National Copyright Administration of China (NCAC), Supreme Peoples' Court (SPP), AQSIQ, universities, etc.

The programme consists of four components:

H = Horizontal component, dedicated to transversal subject-matters and enforcement issues S1 = component dedicated to Patents, Utility Models, Industrial Designs

S2 = component dedicated to Trademarks, and to Geographical Indications S3 = component dedicated to Copyright and Related Rights

PROJECT OBJECTIVES

The overall objective of the programme is to facilitate trade through support for Chinese efforts to implement an international standard of IPR protection.

The specific objective of the programme is to promote IPR protection through support to legislative, judicial, administrative, research and enforcement agencies and institutions.

MAIN PROJECT ACTIVITIES

The general objective of the EU-China Intellectual Property Rights Co-operation Programme is to facilitate trade by supporting the efforts of the Chinese Authorities to develop a modern, effective system of IPR protection through effective and TRIPs-compliant legislation, administration and enforcement, as well as a general awareness of IP.

The programme was split into one horizontal element covering Training of Judges and Lawyers;

Administrative Enforcement; Border Enforcement; Public Awareness; Universities/Research Institutes; Technology Transfer; Legislative Support; International Study Tours; and three vertical specialised elements, covering, respectively:

· Patents, Utility Models and Industrial Designs (Specialised Element S1);

· Trademarks and Geographical Indications (Specialised Element S2);

· Copyrights and Related Rights (Specialised Element S3).

CURRENT ACTIVITIES STATUS (08/2004)

The implementation of the Horizontal Element and the S1 component managed by EPO were completed at the end of February 2004; the S2 component managed by OHIM which started in November 2002 was completed at the end of July 2004, and the S3 component managed by ERIN which started in August 2003 is due to be completed by end of December 2004. Various workshops, seminars and conferences are organised in Beijing and in the provinces, involving the different Chinese IPR agencies at the national, provincial and local levels. Various materials have been produced within the programme.
